MEMORANDUM DE ENTENDIMIENTO PARA EL ESTABLECIMIENTO DE UN GRUPO
CONSULTIVO CONJUNTO PARA LA PROMOCIÓN DEL COMERCIO Y LAS INVERSIONES ENTRE EL MERCOSUR Y LA REPÚBLICA DE COREA
VISTO: El Tratado de Asunción, el Protocolo de Ouro Preto
y la Decisión Nº 32/00 del Consejo del Mercado Común.
CONSIDERANDO:
Que en el ámbito del relacionamiento externo del MERCOSUR se considera
oportuno incrementar los vínculos comerciales y de inversiones con terceros
países.
Que es conveniente establecer un mecanismo de consulta para
profundizar el análisis de los medios y posibilidades de fortalecer las
relaciones comerciales y económicas que contribuyan al desarrollo de relaciones más
estrechas entre el MERCOSUR y la República de Corea.
EL CONSEJO DEL MERCADO COMÚN
DECIDE:
Art. 1 – Aprobar el texto del “Memorandum de
Entendimiento para
el Establecimiento de un Grupo Consultivo Conjunto para la Promoción del Comercio y las Inversiones entre el MERCOSUR y la República de Corea”, en los idiomas
español, portugués, inglés y coreano, que consta como Anexo de la presente
Decisión.
Art. 2 - Esta Decisión no necesita ser incorporada
al ordenamiento jurídico de los Estados Partes, por reglamentar aspectos de la
organización o del funcionamiento del MERCOSUR.

PARA LA PROMOCIÓN DEL COMERCIO Y LAS INVERSIONES
ENTRE EL MERCOSUR Y LA REPÚBLICA DE COREA
La República Argentina, la República Federativa del Brasil, la República del Paraguay y la República Oriental del Uruguay, Estados Partes del Mercado Común del Sur (MERCOSUR) como una
“Parte” y la República de Corea, como la otra “Parte” (en adelante “MERCOSUR” y
“Corea”, respectivamente y “las Partes” conjuntamente);
Deseando promover el comercio y las inversiones entre el MERCOSUR y la República de Corea;
Reafirmando su compromiso de continuar fortaleciendo las reglas del
comercio internacional conforme las reglas de la Organización Mundial del Comercio;
Reconociendo que los acuerdos comerciales contribuyen a la expansión
del comercio mundial y en particular al desarrollo de relaciones más estrechas
entre las Partes;
Teniendo en cuenta la finalización del Estudio Conjunto sobre la Factibilidad de un Acuerdo de Comercio entre MERCOSUR - Corea, de octubre 2007;
Acuerdan lo siguiente:
1.
Objetivos:
Las
Partes deberán:
Explorar las posibilidades y los medios apropiados para fortalecer las
relaciones comerciales y económicas, incluyendo la posibilidad de iniciar
negociaciones comerciales, de conformidad con las reglas y disciplinas de la Organización Mundial del Comercio, y teniendo en cuenta la necesidad de flexibilidad de
cobertura para sectores sensibles.
2.
Grupo Consultivo Conjunto
a. Las Partes establecerán un Grupo Consultivo Conjunto, en adelante
“el Grupo”, a fin de explorar los medios para promover el comercio y las
inversiones, incluyendo la posibilidad de iniciar negociaciones comerciales. El
Grupo será presidido por altos funcionarios de gobierno responsables del
comercio internacional en cada una de las Partes. En el caso de Corea, el
representante designado es el Director General de Política para Acuerdos de
Libre Comercio del Ministerio de Relaciones Exteriores y Comercio. Para el
MERCOSUR, los Coordinadores Nacionales del Grupo Mercado Común o sus
representantes.
b. El Grupo se reunirá cuando lo considere oportuno. Las reuniones del
Grupo tendrán lugar en forma rotativa en Corea y en cualquiera de los Estados
Partes del MERCOSUR, o, a pedido de cualquiera de las Partes, en otra sede
mutuamente acordada.
c.
El Grupo deberá:
1) Intercambiar información sobre comercio e inversiones;
2) Identificar áreas de interés común y llevar adelante
investigaciones y análisis como seguimiento del Estudio Conjunto sobre el
Acuerdo de Comercio MERCOSUR - Corea;
3) Explorar las posibles condiciones y mecanismos para continuar
expandiendo el comercio y la inversión entre las dos Partes; y
4)
Preparar recomendaciones de políticas para futuras etapas.
3.
Cláusulas finales
a. Nada en este Memorandum de Entendimiento afectará los derechos y
obligaciones de cualquiera de las Partes bajo cualquier otro Acuerdo del que
una o ambas Partes sea parte.
b. Las enmiendas a este Memorandum de Entendimiento serán acordadas
por ambas Partes por escrito.
c. Cualquier controversia respecto de la interpretación o aplicación
de este Memorandum de Entendimiento será resuelta por consultas entre las
Partes.
d. Este Memorandum de Entendimiento entrará en vigor en la fecha de su
suscripción y permanecerá vigente por un período de dos (2) años y de allí en
adelante se entenderá automáticamente prorrogado a menos que una de las Partes
decida no renovarlo, mediante notificación escrita y a través de canales
diplomáticos. La denuncia tendrá efecto a los ciento ochenta (180) días
posteriores a la fecha de recepción de la notificación escrita por la otra
Parte.
Hecho en Asunción, el día 23 de julio de 2009, en dos originales, cada
uno en los idiomas español, portugués, coreano e inglés, siendo todos los
textos igualmente auténticos. En caso de dificultades de interpretación de este
Memorandum de Entendimiento, prevalecerá el texto en inglés.

MEMORANDUM OF UNDERSTANDING
FOR THE
ESTABLISHMENT OF A JOINT CONSULTATIVE
GROUP
TO PROMOTE TRADE AND INVESTMENTS
BETWEEN
MERCOSUR AND THE REPUBLIC OF KOREA
The Argentine Republic, the Federative Republic of Brazil, the
Republic of Paraguay, the Republic Oriental of Uruguay, Member States of the
Common Market of the South (MERCOSUR), as one "Party", and the Republic
of Korea, as the other "Party" (hereinafter referred to as
"MERCOSUR" and "Korea" respectively, and as "the
Parties" collectively);
Desiring to promote trade and investments between the Republic of
Korea and MERCOSUR;
Reaffirming their commitment to further strengthen the rules of
international trade in accordance with the rules of the World Trade
Organization;
Recognizing that trade agreements contribute to the expansion of world
trade and in particular to the development of closer relations among the
Parties;
Acknowledging the completion of the MERCOSUR - Korea Joint Study on
the Feasibility of a Trade Agreement in October 2007;
Have reached the following understanding:
1. Objectives
The Parties shall:
Explore the possibility and the appropriate means to strengthen trade
and economic relations, including the possibility of launching trade
negotiations, in conformity with the rules and disciplines of the World Trade
Organization, and taking into account the need for coverage flexibility for
sensitive sectors.
2. Joint Consultative Group
a. The Parties
shall establish a Joint Consultative Group, hereinafter referred to as “the
Group”, to explore means to promote trade and investment, including the
possibility of launching trade negotiations. The Group will be chaired by
senior government officials responsible for international trade in each of the
Parties. In the case of Korea,
the designated representative is
Director General for Free Trade Agreement Policy from the Ministry of Foreign Affairs
and Trade. For MERCOSUR, the National Coordinators in the Common Market Group
or their representatives.
b. The Group shall meet as appropriate. The meetings of the Group will
take place on a rotation basis in Korea and any of the Member States of
MERCOSUR, or, at the request of either Party, in any other mutually agreed
venue.
c. The Group shall:
1) Exchange information on trade and investments;
2) Identify areas of mutual interest and conduct further research and
analysis as a follow up to the Joint Study on Korea-MERCOSUR Trade Agreement;
3) Explore possible conditions and mechanisms for further expanding
trade and investment between the two Parties; and
4) Prepare policy recommendations on future steps.
3. Final Clauses
a. Nothing in this Memorandum of Understanding shall affect the rights
and obligations of either Party under any other agreements to which one or both
Parties are parties.
b. Amendments to this Memorandum of Understanding shall be agreed by
both Parties in writing.
c. Any dispute regarding the interpretation or application of this
Memorandum of Understanding shall be resolved by consultations between the
Parties.
d. This Memorandum of Understanding shall enter into force on the date
of signature and shall remain in force for a period of two (2) years and
thereafter shall be deemed to have been automatically extended unless one of
the Parties decides by written notification and through diplomatic channels,
not to renew it. The termination shall take effect (180) days after the date of
receipt of the written notification by that other Party.
Done in Asunción on the 23rd day of July of 2009, in two originals each in the Spanish, Portuguese, Korean and English languages, all texts being
equally authentic. In case of difficulties in the interpretation of this
Memorandum of Understanding, the English text shall prevail.
